2. Nature of Services
Titan Elite Trading operates as an introducing broker and brokerage services firm focused on connecting experienced, active futures traders with professional-grade trading infrastructure, market access, and brokerage support. Our services include, but are not limited to:
- Brokerage account facilitation and onboarding guidance for futures and futures options trading
- Access to professional trading platforms with advanced charting, order management, and execution tools
- Real-time market data and Level 2 depth-of-market visibility
- Direct broker support for platform orientation, account navigation, and operational questions
- Educational content, webinars, blog articles, and related informational materials
- Third-party platform integrations and API connectivity guidance
All brokerage and clearing services are provided in partnership with a registered futures commission merchant (FCM) that is a member of the National Futures Association (NFA) and regulated by the Commodity Futures Trading Commission (CFTC). Titan Elite Trading does not act as a clearing firm and does not hold client funds directly.
3. Risk Disclosure
Trading commodity futures and futures options contracts involves a high degree of risk and may not be suitable for all investors. You should carefully consider whether trading is appropriate for you given your financial circumstances, experience level, and risk tolerance before opening an account or engaging in any trading activity.
Key risks associated with futures trading include, but are not limited to:

5. Eligibility Requirements
To access and use the services of Titan Elite Trading, you must meet the following eligibility requirements:
- You must be at least 18 years of age (or the age of majority in your jurisdiction)
- You must be a legal resident or citizen of the United States, or otherwise eligible to open a U.S. futures trading account under applicable law
- You must have sufficient financial resources to engage in futures trading and to withstand potential losses without material adverse effect on your financial condition
- You must have relevant trading experience and a working understanding of futures markets, margin requirements, and associated risks
- You must not be subject to any regulatory bar, legal prohibition, or contractual restriction that would prevent you from engaging in futures trading
Titan Elite Trading reserves the right to decline service to any individual or entity at its sole discretion, including but not limited to individuals who do not meet suitability criteria, have a history of regulatory violations, or present compliance concerns.
6. Account Opening & Client Responsibilities
Opening a trading account through Titan Elite Trading requires completion of an account application process in accordance with applicable regulatory requirements, including but not limited to Know Your Customer (KYC) and Anti-Money Laundering (AML) procedures.
By submitting an account application, you represent and warrant that:
- All information provided in your application is true, accurate, complete, and current
- You will promptly notify us of any material changes to your financial condition, trading experience, or personal information
- You have read, understood, and agree to all applicable account agreements, risk disclosures, and regulatory notices provided during the onboarding process
- You accept full responsibility for all trading activity conducted in your account
- You will maintain adequate funds in your account to satisfy margin requirements at all times
Account approval is subject to review and is not guaranteed. Titan Elite Trading and its clearing partners reserve the right to reject any application, close any account, or restrict trading activity for any reason consistent with applicable regulations.
7. Platform & Technology Use
Access to trading platforms, charting tools, order management systems, and related technology is provided subject to the terms of the applicable platform agreement and these Terms. By using any trading platform made available through Titan Elite Trading, you agree to:
- Use the platform solely for lawful trading and related activities
- Not attempt to reverse-engineer, decompile, or circumvent any security or access controls
- Not use the platform for any manipulative, fraudulent, or disruptive trading activity
- Accept that platform availability may be interrupted due to maintenance, technical issues, or circumstances beyond our control
- Take responsibility for maintaining appropriate hardware, software, and internet connectivity to use the platform effectively
Titan Elite Trading makes no warranty that trading platforms will be available without interruption, error, or delay. We are not liable for losses arising from platform downtime, connectivity failures, or technical malfunctions, whether caused by us, third-party providers, or external factors.
Demo and simulated trading accounts are provided for educational and familiarization purposes only. Performance in a simulated environment is not indicative of actual trading results, as simulated trading does not involve real market conditions, real liquidity, or real financial risk.
8. Fees & Commissions
Titan Elite Trading charges commissions on a per-contract basis for futures and futures options trades. All applicable commission rates, exchange fees, clearing fees, and any other charges will be disclosed to you prior to the commencement of trading activity.
You acknowledge and agree that:
- Commission rates may vary by product, contract type, and trading volume
- Exchange fees, NFA fees, and other regulatory charges are separate from and in addition to brokerage commissions
- Fees are subject to change with appropriate notice as required by applicable regulations
- All fees are non-refundable once a trade has been executed
- You are responsible for understanding the total cost of each trade before execution
Where platform access and real-time market data are provided without additional subscription fees, this is subject to the terms of the applicable platform and data agreements and may change. Any changes to fee structures will be communicated in accordance with regulatory requirements.
9. Market Data
Market data, including real-time quotes, depth-of-market information, historical data, and related information, is provided subject to the terms of applicable exchange data agreements. By accessing market data through Titan Elite Trading's platforms or services, you agree to use such data solely for your personal trading purposes and in compliance with all applicable exchange rules and data licensing requirements.
You acknowledge that:
- Market data is provided "as is" without warranty of accuracy, completeness, or timeliness
- Data feeds may experience delays, interruptions, or errors
- Titan Elite Trading is not responsible for trading decisions made based on inaccurate, delayed, or incomplete data
- Redistribution or commercial use of market data is strictly prohibited without express written consent from the applicable exchange
10. Margin Requirements
Futures trading requires the maintenance of margin deposits as security for open positions. Margin requirements are established by the relevant exchanges and may be supplemented by Titan Elite Trading's clearing partners. You are responsible for understanding and meeting all applicable margin requirements at all times.
Important margin-related terms you must understand:
- Initial Margin: The minimum deposit required to open a new futures position, as set by the applicable exchange.
- Maintenance Margin: The minimum account equity required to maintain an open position. If your account falls below this level, you will receive a margin call.
- Intraday Margin: Reduced margin rates that may be available for positions opened and closed within the same trading session. These rates are subject to change without notice.
- Margin Call: A demand for additional funds to restore your account to the required margin level. Failure to meet a margin call may result in the liquidation of your positions.
Titan Elite Trading and its clearing partners reserve the right to liquidate positions in your account without prior notice if margin requirements are not met. You remain liable for any deficit resulting from such liquidation.
The use of leverage through margin can amplify both gains and losses. You may lose more than your initial deposit.
11. Intellectual Property
All content, materials, and intellectual property made available through Titan Elite Trading's website, platforms, educational resources, webinars, social media channels, and other communications — including but not limited to text, graphics, logos, images, audio, video, and software — are the property of Titan Elite Trading or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use Company materials solely for your personal, non-commercial purposes in connection with your use of our services. You may not:
- Reproduce, distribute, publish, or publicly display any Company content without express written permission
- Modify, create derivative works from, or reverse-engineer any Company materials or technology
- Use Company trademarks, logos, or brand elements without prior written consent
- Sell, sublicense, or otherwise commercially exploit any Company content or materials

- No educational material implies or guarantees any specific trading outcome or level of profitability
- Educational content reflects general market knowledge and infrastructure information, not personalized financial guidance
- Past examples, case studies, or hypothetical scenarios presented in educational materials are for illustrative purposes only and are not indicative of future results
- You are solely responsible for applying any educational concepts to your own trading decisions
Titan Elite Trading makes reasonable efforts to ensure the accuracy of educational content but does not warrant that all information is current, complete, or free from errors. Market conditions, regulations, and platform features may change after publication.

- Trading losses or account deficits resulting from your trading activity
- Platform downtime, technical failures, or connectivity interruptions
- Inaccurate, delayed, or incomplete market data
- Reliance on any educational content, informational material, or broker communication
- Unauthorized access to your account resulting from your failure to maintain account security
- Changes in market conditions, regulations, or exchange rules
- Any actions or omissions of third-party service providers, exchanges, or clearing firms
In jurisdictions where limitation of liability for certain damages is not permitted, our liability shall be limited to the maximum extent allowed by law. In no event shall our total liability to you exceed the total commissions paid by you to Titan Elite Trading in the three months preceding the event giving rise to the claim.
You acknowledge that futures trading involves inherent risks that are beyond the control of any broker, and that losses resulting from market movements are not the responsibility of Titan Elite Trading.
15. Indemnification
You agree to indemnify, defend, and hold harmless Titan Elite Trading and its officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to our services, platforms, or materials
- Your trading activity and any resulting account deficits or third-party claims
- Your violation of these Terms or any applicable law or regulation
- Your provision of false, inaccurate, or misleading information in connection with your account application or ongoing use of our services
- Any dispute between you and a third party arising from your use of our services
This indemnification obligation will survive the termination of your account and these Terms.
16. Regulatory Compliance
Titan Elite Trading operates in compliance with applicable regulations, including those established by the Commodity Futures Trading Commission (CFTC) and the National Futures Association (NFA). All marketing, educational, and promotional materials are prepared in accordance with NFA compliance guidelines.
You acknowledge and agree that:
- You are responsible for understanding and complying with all laws and regulations applicable to your trading activity in your jurisdiction
- You will not use our services for any purpose that violates applicable law, including but not limited to market manipulation, insider trading, or money laundering
- You will cooperate with any regulatory inquiry, audit, or investigation as required by law
- You will promptly notify us of any regulatory action, investigation, or legal proceeding involving your trading activity
Titan Elite Trading reserves the right to report suspicious activity, cooperate with regulatory authorities, and take any action necessary to maintain compliance with applicable laws and regulations.

19. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the federal and state courts located in Cook County, Illinois, except as otherwise required by applicable regulatory frameworks.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class action, collective action, or representative proceeding.
